A third-time DUI offender may be sentenced to 120 days to 12 months in jail, with all but 15 days that may be suspended or probated. If the conditions of your probation are violated, you may be ordered to serve out your suspended sentence. Third offenders must also serve 12 months of probation. Fines ranging from $1,000 to $5,000, plus statutory surcharges, may also be ordered.

The minimum community service time is for a third offense is 30 days. Community service may consist of working with anti-DUI organizations or picking up trash off of the highway. The judge will determine your actual community service time.

The driver’s license penalty for a third offense within five years is a five year revocation. To obtain a probationary license after two years, you must complete an alcohol education course (“DUI School”), alcohol assessment, and counseling, and install an ignition interlock device in your vehicles.

One of the more embarrassing punishments for a third-time DUI offender is that you will have to have your photograph, name and address published in your local newspaper. You are responsible for paying the $25 notice fee.

You could also be required to surrender the license plates for all vehicles in your name. Only after obtaining a probationary license or full license reinstatement will your license plates be reissued. In some cases, you may request a special hardship plate for family members or co-owners of the vehicle.
