Atlanta DUI First Offense
A person who is arrested and charged with an Atlanta driving under the influence (DUI) offense may face a lot of uncertainty.
A driver accused of drunk-driving may be unsure of the penalties associated with a drunk-driving conviction and worried about going to jail or having his or her license suspended. If convicted of an Atlanta DUI first offense, you could be required to pay fines ranging from $300 to $1,000 as well as any applicable statutory surcharges. Jail time may range from 10 days to 12 months, though all but 24 hours may be suspended or probated. This means that you do not have to serve the total amount of jail time unless you commit another crime or violate the terms of your probation.
According to Atlanta law, you may be required to perform a minimum 40 hours of community service. If you are under the age of 21, you must perform at least 20 hours of community service. First offenders may be allowed to choose where they perform community service, especially if it is a cause they feel strongly about. The judge will determine the actual amount of community service.
Drivers over the age of 21 may have their license suspended for one year, though you may be eligible to get it back after 120 days if you complete an alcohol education program (such as DUI School) and pay the reinstatement fee. Before those 120 days are up, you may be eligible for a hardship (limited) driving permit that allows you to drive to work or other court-approved locations.
Drivers under the age of 21 may have their license revoked for six months with a BAC under .08% or 12 months with a BAC of .08% or higher. No limited permit will be granted.
In addition to these court-imposed punishments, a person with a DUI on his or her record may be subject to increased insurance premiums. In some cases, the insurance provider may deem him or her “high-risk” and decide to drop the policy.
